TERMS AND CONDITIONS OF PHOTO AND VIDEO SERVICES
BASIC PROVISION
These general terms and conditions (hereinafter referred to as „terms and conditions“) are issued in accordance with § 1751 et seq. of Act No. 89/2012 Coll., Civil Code (hereinafter only „Civil Code“)

ORDERING SERVICES
The order is binding at the moment of agreement on the date of service provision by both the client and the supplier
By ordering a photoshoot/filming, you automatically confirm acceptance of these conditions and your understanding with them, as well as with our author’s approach and style
Reservation of the wedding date – Within 7 days of the agreement, the reservation fee should be paid to account IBAN CZ5103000000000262825520 BIC (SWIFT) CEKOCZPP, which is non-refundable. The reservation fee is € 450,- and is an advance payment. In case of non-payment, the date can be offered to another interested party.
Cancellation of reservation
If the photo shoot/filming session is canceled by the service provider, the booking fee is refunded in full or is moved to an alternative date after written agreement via email. If, for any reason, the client is unable to attend the agreed photo shoot/filming and requests its cancellation or an alternative date, it is his duty to notify the photographer of this fact by phone or e-mail at least 3 days before the photo shoot. In the case of wedding photography/filming, it is not possible to cancel the date after paying the reservation fee and request a refund of this fee. If the client has a request to move the photo/filming date and the photographer does not have the required date available, then the booking fee is non-refundable, as there was no problem on the part of the service provider.
Alternate term
The client acknowledges that if he requests an alternative date, he will be offered the nearest possible free date, taking into account the current workload
Maturity of prices
The price for the selected package is payable no later than on the day of the photo shoot/filming. You can pay both in cash and by transfer to the above account.
The price for photos, videos and work selected beyond the scope of the package is paid in the form of an additional payment by transfer to the account even before they are processed
If the price of the selected photo package or any additional payment for additional services beyond the scope of the package is not paid, the photographer reserves the right not to hand over the order until it has been properly paid
PHOTOGRAPHY/VIDEO RECORDING
We reserve the right to be the sole photographer/cameraman at the wedding. Another photographer/cameraman who is supposed to be at the wedding is only possible by prior arrangement.
Photo/filming time
The photo/filming time is individual and varies depending on the selected package
Photo/video editing
Unless we agree otherwise, we edit photos and videos at our discretion and overall style, which is evident from the photos and video clips published on this website.
We adjust contrast, colors, light, small skin imperfections, scars. The resulting adjustments can make the entire photo different from the original.
Limitation of Liability and Claims
The photographer/cameraman is not responsible for non-delivery, reduced quality of photos and recordings due to reasons beyond his control. It can be, for example, obstacles posed by the wedding guests, bad and unpredictable filming of the guests and the betrothed towards the lens of the camera/camera. Prohibition or restriction of access to suitable places to take pictures by registrars or parish priests. Too dark spaces. Inappropriate lighting or backlighting. Bad weather. Unsightly backgrounds, clothing flaws, bad make-up. Insufficient information and cooperation from, for example, DJ. If the client has a specific request to capture a certain object, person or event at the wedding, they must inform us of this request sufficiently in advance.
For the reasons stated above, we are not responsible for the non-delivery of any record of an item or person at the wedding. The client acknowledges that each person is different, has his own unique appearance, and therefore the aesthetic quality of photos and videos varies. Your own appearance and dissatisfaction with it is in no way a reason to complain about the work.
In unlikely cases that prevent us from providing the ordered services on the agreed date, our responsibility and obligations are limited to the return of the reservation payment received. It can be, for example, illness, injury, road accident, theft, breakdown, destruction of equipment.
DELIVERY OF PHOTOGRAPHS AND VIDEO RECORDING
Delivery time of photos/videos
Normal delivery time is 2 weeks to two and a half months. It depends on the current workload of the photographer/cameraman. We reserve the right to extend the deadline at any time, e.g. due to excessive workload, illness, or malfunction of photo and video processing equipment.
Transfer of photos and videos
You will receive the edited photos in .jpg format in full resolution. We do not provide RAW format files or unedited photos in JPG!
Photos are supplied in electronic form in multiple resolutions by sending a download link and a link to the online gallery.
You will get the videos edited in .mp4 format by sending the download link and YouTube link to share the wedding video clip. We do not provide unedited and uncut ProRes RAW and C.Log3 video files!
Photo and video archiving
All photos are archived for at least 1 year from the submission of the order, after which the data is gradually deleted in accordance with the EU Regulation 2016/679 on the protection of natural persons (so-called GDPR). Video recordings are stored for a maximum of two months, taking into account their size. The client must therefore carefully back up and protect the transferred files.
CONSENT TO PROVIDE PHOTOS AND VIDEOS
Unless we agree otherwise, the author of the photos (videos) has the right to publish the photos in the portfolio, on social networks (instagram, facebook, …) or on his website and YouTube channel.
COPYRIGHT
According to Copyright Act No. 121/2000 Coll. the photographs are the property of the photographer and may not be used for any commercial purpose, promotion or sale to a third party without the written consent of the author, unless these photographs are directly for the customer’s promotional use. Photographed persons may use the photographs for their non-commercial personal presentation.
The client may use the photos for personal purposes only.
The client may not use the photographs for commercial purposes or sell them without the written consent of the photographer. The same rules apply to videos.
PERSONAL DATA STATEMENT
I declare that your provided data will be considered personal and therefore according to Act 101/2000 Coll. (Act on the Protection of Personal Data) I guarantee their protection and in no case will I provide them to a third party, and that I will use them exclusively for my own needs
